- Announcements
On March 12, 2003, Denise L. Page gave a presentation on Division of Marital
Assets in Divorce at the Framingham Civic Center. The event was sponsored
by the Divorce Center, a non-profit group that educates the public regarding
family law issues.
Denise L. Page will serve as a faculty member for a seminar entitled
"Complex Issues in Divorce for the Massachusetts Practitioner". Ms.
Page's presentation will focus on Child Custody and Support, The Lawyer's
Ethical Responsibility During the Dissolution of Marriage, and the Complex
Divorce Action. The seminar will be held on September 5, 2003 in Boston and
is sponsored by the National Business Institute.
Kevin F. Moloney is mentioned in the February 14, 2003
Boston Business Journal article entitled "Hilfiger and Polo claim
Building 19 sold fake goods". Mr. Moloney represents Tommy Hilfger
and Polo Ralph Lauren in the claim. If you would like a copy of

On April 15, 2003, Julie Taylor Moran and Denise Page
served as faculty members for a seminar entitled "Commercial and
Residential Evictions in Massachusetts: How to do them Right".
The seminar will be held in Boston and is sponsored by Sterling
Education Services, LLC.
On October 29, 2002, David P. Dwork served as a faculty
member for a seminar entitled Damages in Massachusetts Civil Trial
Practice. The seminar, sponsored by the National Business Institute,
will be held in Boston.
- Litigation Victories
On March 17, 2003 in a 26 page Memorandum and Decision by Chief
Judge
William Young, in Restaurant Consulting Associates, et al v. Mountzuris,
the
federal court confirmed an arbitration award for our client (defendant
Mountzuris) against plaintiff corporations whose motion to vacate
the award
was denied. The decision confirms an award by an arbitrator that
plaintiff
corporations are liable to Mountzuris under an indemnity obligation
in an
employment agreement, against claims, among others, that the indemnity
liability and arbitrability had been released. The judge confirmed
the
arbitrator's award of liability for $294,000 in past attorneys'
fees
incurred by Mountzuris in defending against a state court case
against him
by Cummings Properties that Mountzuris is liable for more than
$900,000 on a
guaranty of a commercial lease. This case has not yet been decided
by the
state court. The Young decision also confirmed the arbitrator's
award that
plaintiffs are required to indemnify Mountzuris for any judgment
that might
enter against him in that state court action.
- Community Involvement
On October 6, 2002, Kelly A. Flynn ran the Maine Marathon
in Portland, Maine for the Lymphoma and Leukemia Society's Team
