Kevin F. Moloney concentrates in business, banking, real estate and zoning and other litigation.  Mr. Moloney has been helping clients with complex disputes for over 40 years. His clients have ranged from large, multi-national corporations to federal government entities to local, small businesses and individuals. He has tried or settled numerous cases involving complex issues including breach of fiduciary duty, land use and zoning, trademark infringement, employment discrimination, corporate governance and other disputes.

Prior to joining Barron & Stadfeld over 25 years ago, Mr. Moloney was Assistant Corporation Counsel for the City of Boston and Chief Contracts Division (1968-1977) and served as the City of Boston’s First Assistant Corporation Counsel (1977-1979).  He has published articles on public contract matters and on civil rights issues.

Over the years, Mr. Moloney has been very involved in community activities in Boston. A Trustee of the Boston Latin School Association (1970s), Mr. Moloney served as President of the Board of Trustees of the Boston Public Library (1984-1990). A member of the Massachusetts Board of Library Commissioners (1985-1991), he was President (2000-2007), Treasurer (1985-1999) and Trustee (1985-2007) of the Eliot School of Fine and Applied Arts.  A board member of the Arborway Committee, Inc. since 1995, Mr. Moloney served as an elected member of the Jamaica Plain Neighborhood Council (1991-1999), Chair of its Zoning Committee (1992-1993) and Chair of the Council (1994-1999).  He has been for many years a board member of the Jamaica Pond Association (1975-2008) and currently serves as Chair of its Zoning Committee.

Select Cases

  • Successful defense at trial and on appeal of claim against corporate officer personally for damages in excess of $980,000 based on personal guaranty of corporate lease. Defense established that the guaranty had been obtained by the landlord's fraud.
     
  • Federal court settlement for the FDIC in breach of fiduciary duty case against directors of failed bank
     
  • Successful defense in the Trial Court of developer of low/moderate income housing in case brought by State Representative and another claiming that town’s grant of permit was improper
     
  • Successful Land Court defense of developer in zoning case, allowing construction of subdivision to proceed
     
  • Successful Federal court defense at trial and on appeal of county sheriff against civil rights claims that employment actions of sheriff were politically motivated
     
  • Seven figure settlement of breach of fiduciary duty case against trustees and other fiduciaries of publicly held real estate investment trust
