Bankruptcy

Barron & Stadfeld, P.C. aggressively represents clients in bankruptcy and insolvency matters, fashioning creative solutions to our clients' problems, whether simple or complex. We represent creditors, debtors, trustees and others in both business and consumer bankruptcies and also in negotiating workouts or loan restructurings outside of the bankruptcy courts. We also represent both secured and unsecured creditors in filing claims in bankruptcy cases and litigating objections to those claims. Our representation includes both plaintiffs and defendants in litigation within bankruptcy cases, including complaints to recover preferential transfers or fraudulent conveyances as well as other contested matters.

We take pride in helping our clients to achieve their objectives as quickly and cost effectively as possible. Frequently, we represent secured creditors in seeking relief from the "automatic stay" of the Bankruptcy Code, enabling them to maximize their return by liquidating collateral in a timely and organized way. Where relief from the automatic stay is not an option, we help our secured clients seek "adequate protection" of their interests in collateral for so long as the collateral remains subject to the automatic stay. We counsel lessors of real or personal property in resolving the status of their leases and leased property in bankruptcy cases and have acted on behalf of clients interested in acquiring assets from bankrupt entities or other entities in financial distress.

Our representation of certain clients involves, from time to time, providing assistance to people seeking bankruptcy relief under the Bankruptcy Code. Doing so makes us a "Debt Relief Agency" within the meaing set forth in the Bankruptcy Code.
