Can a condominium association ban smoking in the condominium?
The Board of Directors or the Trustees of a condominium association can establish rules and regulations dealing with the common areas of the condominium. As such, they could ban smoking in the hallways and the interior parts of the building, as well as the exterior common areas of the building. However, they could not ban smoking in a particular condominium unit by the owner or his guests unless there was a provision in the condominium documents which would prohibit smoking in the unit.
